Straight Facts about Workers Comp

When you have been injured on the job, you can easily be misled by false information about your rights. Your employer may lead you to believe that you have limited rights or friends or family may have heard "rumors" about your eligibility for benefits. In our years of practice, we have learned of many common misperceptions from clients who sought workers comp benefits. Here are the straight facts:

  • Temporary benefits do not prevent you from further recovery. Just because your employer offers you temporary benefits doesn't mean you don't have the right to further benefits.

  • Your employer is required by law to have workers comp insurance. If your employer attempts to deny a claim by telling you they don't have workers' comp insurance, you can still file a claim under the workers' comp laws.

  • Undocumented workers have a right to workers' comp benefits. Your employer cannot deny you workers' compensation benefits because you are an undocumented worker.

  • You have the right to additional benefits and treatment. If your case has been resolved, but your treatment and/or your benefits are inadequate, you can request a modification of the order to obtain additional benefits or treatment.

  • You have the right to a second opinion. When you file your claim, you will be required to have a consultation with an insurance company doctor. If that doctor denies your claim, you have the right to obtain a second opinion from a doctor of your choice.

  • A voluntary permanent disability payment does not bar you from further recovery. If the insurance company offers you a permanent disability payment and you accept it, you may still be able to file a claim for additional compensation.

  • A work-related injury does not have to be the result of a single incident. You have a right to workers' comp benefits for an injury that has developed over time, including carpal tunnel or repetitive stress syndrome.

  • Handling your claim without an attorney only helps the insurance company. Many insurers will tell you not to hire an attorney, as you will save the attorney fees and can settle in court without an attorney. In reality, this saves the insurance company money and pits you against your employer and the insurance company without any guidance. The insurance company will be represented by lawyers...you should be, too.
